Welcome to Throw No More!

Thank you for using our App, products, and services (“Services”). The Services are provided by Throw No More AS organization number 917245444 (“TNM” or “we”). By using our Services, you are agreeing to these Terms and Conditions (“Terms”). These terms must be viewed in conjunction with TNM’s Privacy Policy, as available on the App or our website and shall be automatically accepted upon acceptance of these Terms. Please read them carefully. If you do not agree to these Terms, please do not use the Services.

1. The purpose of the TNM’s app

The TNM’s app is a digital Service that gives end users an overview of the reduced priced goods that grocery stores have on offer, either because the goods are approaching their expiration dates or because they cannot be sold at full price for other reasons. The purpose of the Service is to reduce food waste in grocery stores by giving users an overview of these items. Users can then go to the store and buy the discounted items in the app. In this way, many items are sold instead of being wasted.

1.1. How the Service works

The user downloads the Service in Google Play® or AppStore®. By using the app, the user accepts these Terms and the Privacy Policy. The user can insert a zip code or share their location, after which the user gets a list of grocery stores in the center of the zip code or around the shared location.

The user gets an overview of stores that have discounted items with information like regular price, current price, number of items left, and picture of the item. The user can go to the store and buy the items at a reduced price, so that they are not wasted.

There are two types of users in the Service: registered and unregistered. The user can sign up with an email address and has the option of including their first name, surname, and age. The user can edit these optional fields later in the settings. The registered user can sign in using an email or Facebook or Google account. After signing in, the registered user can use all the aforementioned features, as well as the following features. The registered user can add items to a shopping list from different stores and see the total price and the total items that are added to the shopping list. The user can share the shopping list with others by sending a URL to them using external tools like SMS. The shared shopping list is a web page on the TNM website. The registered user has access to a page called “Tips” that includes weekly tips about food waste and recipes. Both registered and unregistered users can receive push notifications optionally. It is possible to deactivate push notifications in settings. The registered user can reset the password or delete the account in settings. At the time of writing, the Service is available in English, Norwegian and French. It will be available in other languages in due course.

3. Throw No More rights

The Throw No More App and its Services, content, editorial content, features, and functionality are and will remain the exclusive property of Throw No More AS.

4. Use of the Service

4.1. Costs of use
There are no costs for using the app other than the use of mobile and mobile data. To use the Service, access to the internet is required, this use is invoiced via a mobile provider and is outside Throw No More’s area of responsibility. The price of data traffic depends on the mobile subscription and can vary from provider to provider.

4.2. Access to the Service
The Service will normally be available every day between 00.00 and 24.00. If an error occurs during a period of unattended operation, i.e. outside normal working hours, it may happen that error correction is not initiated before the next working day. Time limit for error correction depends on how critical the error is. The Service can be taken down without notice for maintenance.

4.3. Behaviour in store
When trading goods in a store as a result of using the Service, Throw No More requests that the user shows respect for the store’s other customers and employees.

5. Limitation of liability

We work hard to provide the best Service we can and to specify clear guidelines for everyone who uses the Service. However, the Service is provided “AS IS”. We cannot predict when problems might arise with our Services. Accordingly, our liability shall be limited to the fullest extent permitted by applicable law, and under no circumstance will we be liable to you for any lost profits, revenues, information, or data, or consequential, special, indirect, exemplary, punitive, or incidental damages arising out of or related to these Terms or the TNM Services, even if we have been advised of the possibility of such damages. Your use of this Service is entirely at your sole risk.

5.1. Transaction
TNM is not a party to the transaction of goods between buyer (user) and seller (store). The sale of food takes place in accordance with the store’s purchase conditions.

5.2. Available items
TNM is not responsible for the availability of products in stores. At all times, we strive for the number of products in the app to match the store’s reduced items data. However, we can not ensure that other customers in the store have the reduced items in their physical shopping basket.

5.3. Condition of the item
TNM is not responsible for the condition of the item when the user arrives at the store. The stores adhere to their regulations regarding discounted goods, independent of TNM’s Service. TNM will not in any way handle or be responsible for the production, storage, ingredients, allergies, packaging, processing, purchase, sale or other handling of products. Any complaints about the condition of the item must therefore be directed to the store, but TNM again requests that the user shows respect for the stores and their employees.

5.4. Service
The Service is subject to strict safety requirements and service requirements. However, TNM cannot guarantee that the Service will be error-free or accessible to the user at all times. TNM is not responsible for any errors or omissions in the Service if such failure is caused by circumstances beyond TNM’s control. Such circumstances include, but are not limited to, disruptions to the operation of the Service or affiliated stores as a result of legislation, state, or public authorities, acts of war, terrorism, strikes, physical blockades, pandemics, and natural disasters.

6. Change of Terms of Use

We may modify these Terms or any additional Terms that apply to a Service. You should look at the Terms regularly. We will post notices of modifications to these Terms on this page.

If you do not agree to the modified Terms for a Service, you should discontinue your use of the Service.

7. Other provisions

The Terms of Use are subject to and shall be interpreted in accordance with Norwegian law.
